These Terms govern your use of the Caliana mobile application ("the App", "Caliana"). By installing or using Caliana, you agree to these Terms. If you do not agree, do not use the App.

1. The service

Caliana is an AI-powered calorie tracking and nutrition coaching app. It lets you log meals by voice, photo, or text, and provides AI-generated estimates and suggestions.

2. Eligibility

You must be at least 13 years old (or 16 in the EU/UK) to use Caliana. By using the App you confirm that you meet this requirement.

3. Account & access

Some features may require you to keep certain settings on your device or sign in. You are responsible for keeping your device and any credentials secure.

4. Acceptable use

You agree not to:

• Use Caliana for any unlawful purpose.
• Attempt to reverse engineer, decompile, or extract the source code of the App, except where permitted by law.
• Send content that infringes others' rights, contains malware, or attempts to overload, probe, or attack our systems.
• Use Caliana to provide medical, dietary, or therapeutic services to third parties.

5. AI output — not medical advice

Caliana's calorie estimates, nutritional information, recipe suggestions, and chat responses are generated by AI and are provided for general informational purposes only. They are not medical, dietary, or professional advice. Always consult a qualified healthcare or nutrition professional before making decisions about your diet, particularly if you have a medical condition, allergies, or are pregnant or breastfeeding. AI output may be inaccurate, incomplete, or out of date.

6. Your content

You retain ownership of any content you provide (voice clips, photos, text). By submitting content, you grant Caliana a limited, worldwide, royalty-free licence to process that content solely to provide the App's features. We do not use your content to train AI models.

7. Third-party services

Caliana relies on third-party services (OpenAI, ElevenLabs, Serper, Firebase, Railway). Their availability and behaviour are outside our control, and your use of those services may be subject to their own terms.

8. Subscriptions & payments

Caliana offers an auto-renewing subscription, Caliana Pro, that unlocks unlimited photo logging, voice playback, multi-day rebuild plans, and saved meal suggestions. The subscription is sold through the Apple App Store (and, where applicable, Google Play); your purchase is governed by the relevant store's terms in addition to these Terms.

• Title: Caliana Pro.
• Length and price: Monthly — $5.99 per month; or Annual — $39.99 per year (which works out at roughly $3.33 per month). Prices may vary by region; the price displayed in the App at the point of purchase is the price you pay.
• Free trial (annual only): Annual subscriptions begin with a 7-day free trial. You will not be charged during the trial. If you do not cancel at least 24 hours before the trial ends, the subscription auto-renews and you will be charged the annual price.
• Auto-renewal: Subscriptions automatically renew at the end of each period unless you cancel at least 24 hours before the period ends. The renewal price is the same as the period you signed up for, unless we have notified you of a price change in advance and you have accepted it.
• Cancellation: You can cancel at any time from your Apple App Store account settings (Settings → [your name] → Subscriptions on iOS) or, on Android, from the Google Play Store. Cancelling stops the next renewal; your subscription remains active until the end of the current paid period.
• Refunds: Refunds are handled by the App Store or Google Play under their published refund policies. Caliana does not process refunds directly.
• Restore purchases: If you reinstall the App or change device, you can restore an active subscription from the paywall screen.

By subscribing, you authorise the relevant store to charge your payment method on each renewal date for the price shown above (plus applicable tax) until you cancel.

9. Intellectual property

The App, its branding, design, and underlying software are owned by Caliana and protected by intellectual property laws. These Terms do not transfer any of those rights to you.

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or fit any particular health goal.

11. Limitation of liability

To the maximum extent permitted by law, Caliana, its affiliates, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of (or inability to use) the App. In no event will our total liability exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) £50.

12. Termination

You may stop using Caliana and delete your account at any time. We may suspend or terminate access if you breach these Terms or if continuing to operate the App becomes impractical.

13. Changes

We may update these Terms. We will indicate the "Last updated" date and, for material changes, notify you in the App. Continued use after changes means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer law in your country of residence provides otherwise.
